Terms of Service

1. Agreement to Terms

By accessing or using PlayParty.io ("Service", "we", "us", "our"), including our website, API services, media compatibility utilities, companion browser extension, and voice/video features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2. Service Description & Media Disclaimer

PlayParty.io provides synchronization software that coordinates playback timing, text chat, and WebRTC voice/video communication between users watching the same media URL or stream.

No Media Hosting: PlayParty.io does not host, upload, store, transcode, or broadcast video or audio content. Media streams are decoded and played directly in each user's web browser from external URLs provided by participants or indexed via public third-party sources.

Technical Synchronization Architecture: PlayParty operates strictly as a real-time playback coordination layer:

• Real-time WebSocket timestamp signaling that keeps all room participants frame-synchronized with sub-50ms latency.
• Search and discovery tools that assist users in finding publicly available video metadata from supported platforms.
• A self-hosted WebRTC media routing architecture for low-latency voice and video communication between room participants.
• Direct client-to-CDN streaming where media files and stream manifests decode natively inside each user's local web browser without passing through our servers.

PlayParty does not host, upload, re-encode, or store third-party media files.

3. Eligibility & User Accounts

You must be at least 13 years old (or 16 in certain jurisdictions) to use the Service. By registering an account, you represent that you meet these age requirements.

• Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account.
• Registration: You may register via email and password or third-party authentication (Google OAuth / One Tap). You agree to provide accurate and truthful information.
• Account Deletion & Grace Period: You may request account deletion at any time in Settings → Privacy. Deletion requests have a 30-day grace period during which signing back in will cancel the deletion request. After 30 days, your account and all associated profile data are permanently erased.

4. Acceptable Use Policy

You agree to use PlayParty.io in compliance with all applicable laws. You specifically agree not to:

• Use the Service to stream, share, or facilitate access to unlawful, infringing, obscene, harassing, or harmful content.
• Abuse our server infrastructure, including attempting Server-Side Request Forgery (SSRF), scanning internal IP networks, probing ports, or flooding any API endpoints.
• Circumvent, disable, or tamper with security features, rate limits, token authentication, or room access controls.
• Attempt to bypass Digital Rights Management (DRM), geo-blocks, or technological protection measures on copyrighted content.
• Deploy automated scrapers, bots, or spiders against our APIs, search endpoints, or WebRTC servers without express authorization.
• Harass, intimidate, stalk, or transmit hate speech or abusive messages via room chat or voice/video channels.
• Impersonate any person or entity, or misrepresent your affiliation with PlayParty.io or any third party.

5. User Content, Avatars & Moderation

You are solely responsible for all content you submit, including usernames, room titles, chat messages, and custom profile avatars:

• You warrant that you hold all necessary rights and permissions for any content you upload or share.
• Room hosts have the authority to set passwords, kick, or ban participants from their respective rooms.
• We reserve the right, but have no obligation, to remove content, terminate rooms, suspend accounts, or enforce moderation bans for violations of these Terms.

6. Companion Browser Extension

The optional PlayParty companion extension detects video stream URLs on pages you actively visit and adjusts cross-origin headers to enable synchronization. The extension is provided "as-is". You agree to abide by the terms of service of any third-party websites you visit while using the extension. The extension must never be used to circumvent copyright protection mechanisms.

7. Copyright & DMCA Safe Harbor Policy

PlayParty.io is a decentralized real-time timeline synchronization platform. PlayParty does not host, upload, re-encode, store, or relay video or audio media files. Media streams are retrieved and decoded directly by end-users' local web browsers from third-party content providers.

We strictly adhere to the safe harbor provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable international copyright directives.

7.1 Notice and Takedown Procedure

If you are a copyright owner or authorized agent and believe that any room, user-submitted title, or link accessible on PlayParty infringes upon your copyright, please submit a written DMCA takedown notification containing the following details:

• A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the specific PlayParty room URL or domain name to enable us to locate the material.
• Your contact information, including your full legal name, physical address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

7.2 Counter-Notification Procedure

If you believe that your room or content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification pursuant to 17 U.S.C. § 512(g)(3) containing your contact information, identification of the disabled material, a statement under penalty of perjury of good faith belief that the material was removed by mistake, and consent to federal court jurisdiction.

7.3 Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i)(1)(A), PlayParty.io maintains and enforces a strict policy to terminate, in appropriate circumstances and at our sole discretion, user accounts, room creator privileges, or access rights of users who are repeat infringers of intellectual property rights. We also reserve the right to immediately block or blacklist entire source domains that are repeatedly subject to valid copyright notices.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

WE DO NOT GUARANTEE THAT PLAYBACK SYNCHRONIZATION WILL BE ERROR-FREE, THAT THIRD-PARTY MEDIA STREAMS WILL REMAIN ACCESSIBLE, OR THAT OUR SERVER UTILITIES WILL BE COMPATIBLE WITH ALL VIDEO FORMATS OR NETWORK ENVIRONMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAYPARTY.IO, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• YOUR ACCESS TO OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY THIRD-PARTY CONDUCT OR CONTENT ON THE SERVICE;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless PlayParty.io, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable to PlayParty.io's place of registration, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, subject to mandatory local consumer protection laws.
